Hire Agreement

1. Hire Agreement
The Owner agrees to let, and the Hirer agrees to take on hire, the Vehicle described overleaf. “Owner” means the hire point listed overleaf. The Owner warrants that the Vehicle is roadworthy.
2. Extension of Hire Period
The Owner may extend the period of hire at the request of the Hirer. The Hirer shall pay such additional deposit or deposits as the Owner may require. In the event of any extension, the new date and time agreed for the return of the Vehicle shall become the due return date, unless the contract otherwise provides. In no event shall the total duration of the hire exceed three months.
3. Warranty by Hirer and Additional Driver – Owner Rights
a) The Hirer agrees to return the Vehicle to the Owner in the same condition as received, ordinary wear and tear excepted, on the due date specified overleaf.
b) The Hirer agrees not to use the Vehicle for hire or reward, nor use it in violation of any law, ordinance, or regulation, nor remove it (without prior written consent of the Owner) from England, Scotland, or Wales.
c) The Hirer hereby warrants and undertakes to the Owner:

The accuracy of the information supplied to the Owner;

That, in the case of business hire, this Agreement is entered into by the Driver for and on behalf of the Hirer;

That the Hirer will not operate, or permit the Vehicle to be operated, in any way that would violate this Agreement, including:

Driving by any person under 25 or over 70 years of age;

Use in any motorsport events, including racing, pace-making, rallying, reliability trials, or speed testing;

To propel or tow any vehicle or trailer;

Driving while unfit through drink or drugs, or with a blood alcohol concentration above the legal limit;

Driving by any person other than the Hirer or Additional Driver shown overleaf;

Driving under the authority of any licence other than the driver’s own;

Leaving the Vehicle unlocked or failing to secure the keys;
-
Driving other than on a paved public highway, private road, or driveway;

Driving in a reckless or imprudent manner, or deliberate damage to the Vehicle.

The Hirer further warrants that the licence shown to the Owner at the time the Vehicle is rented is valid and held in their own name.
The Hirer shall protect the interests of the Insurer and the Owner by ensuring the Vehicle is always locked when unattended and that the keys are kept secure.
d) If the Hirer commits any breach of this Agreement, the Owner may treat the Agreement as terminated and may seize the Vehicle without legal process or notice at any time and place. The Hirer waives all claims for damages connected with such seizure.
e) The Hirer authorises the Owner to verify, through credit agencies, the Driver and Vehicle Licensing Agency, or any other source, personal, driving, and credit information provided by the Hirer and any Additional Driver shown overleaf.
4. Payment
The Hirer expressly agrees to pay the Owner on demand:
a) Mileage charges at the rate specified overleaf, plus other applicable charges, even if an account is forwarded to a third party;
b) Service and time charges at the rate specified overleaf, plus other applicable charges;
c) Collision Damage Waiver (if any), Theft Protection Insurance (if any), Personal Accident Insurance (if any), Legal Liability Insurance (if any), and miscellaneous charges at the rates specified overleaf;
d) All fines, penalties, and court costs for parking, traffic, or other legal violations assessed against the Vehicle, Hirer, Driver, or Owner until the Vehicle is returned, except where caused by the fault of the Owner;
e) Any refuelling charges operated by the Owner;
f) Value Added Tax and any other applicable taxes;
g) The Owner’s costs, including reasonable legal fees where permitted by law, incurred in collecting payment due from the Hirer;
h) The fair market cost of repairing damage to the Vehicle, administrative fees, loss of revenue based on loss of use, diminution of value, towing, storage, and impound fees, regardless of fault or negligence;
i) In the event of theft, the fair market value of replacing the Vehicle, administrative fees, and loss of revenue, unless Theft Protection Insurance applies;
j) Drop-off fees if the Vehicle is not returned to the original hire office without written consent;
k) The Hirer authorises the Owner to compute and debit final charges to the credit card provided.
5. Hirer’s Own Insurance
If the Hirer has selected “own insurance” overleaf, the Hirer shall maintain comprehensive insurance approved by the Owner. The Hirer agrees that all terms of this Agreement apply regardless of insurance selection.
Owner’s Insurance
Where applicable, the Hirer is insured subject to the terms of the Owner’s policy and shall pay any applicable excess.
6. In Case of Accident
The Hirer shall ensure that:
a) Insurers are notified immediately and in writing within 24 hours;
b) An accident report is completed within 24 hours;
c) No admission of liability is made;
d) All legal documents are forwarded to the Owner;
e) Full cooperation is provided to the Owner and insurers;
f) The Owner is indemnified against uninsured losses;
g) Witness details are obtained and provided.
7. Hirer’s Indemnity
The Hirer agrees to indemnify and hold the Owner harmless from all losses, liabilities, claims, and expenses arising from the hire or use of the Vehicle.
8. Credit Card Authority
The Hirer authorises the Owner to submit credit card charges for all amounts due, including where a third party fails to pay.
9. Final Audit
All charges are subject to final audit.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England. All disputes shall be subject to the exclusive jurisdiction of the English courts.
Statement of Liability
I confirm that I have declined CDW and/or TPW as my credit card provides cover. I authorise the Owner to charge my nominated credit or debit card for the full replacement or repair cost of the Vehicle and any associated loss of use.
